DUNDEE TOWNSHIP
REGULAR MEETING
NOVEMBER 13, 2007
The regular meeting of the Dundee Township Board was held Tuesday November 13, 2007 at the Dundee Township Hall. Supervisor Uhl called the meeting to order at 7:00 p.m. The Pledge of Allegiance was recited. Present were Supervisor Uhl, Clerk Lupu, Treasurer Goetz and Trustees: Larson, Lazette, Juckette and Williams. Approximately twelve citizens were present.
Motion by Trustee Williams and supported by Treasurer Goetz to approve the agenda as printed. Motion carried.
Motion by Trustee Juckette and supported by Trustee Larson to approve the minutes of the regular meeting held Tuesday October 23, 2007 and waive the reading of such. Due to their absence from the meeting Supervisor Uhl and Trustee Lazette abstained from voting. Motion carried.

OFFICIAL REPORTS
Supervisor Uhl
A litigation agreement has expired for a pond project by Dennis Curry located on Irish Road. The original permit was issued on November 12, 2002 with an additional extension granted on April 13, 2004. In order to develop proper sloping in the pond, Mr. Curry illegally pumped water into the Wittkop Drain. The pumping obstructed the drain with large amounts of sand. Board members received several phone calls from neighbors voicing complaints from the work being done on the property and the surrounding area. This drain is essential to area farmers that have field tiles. The Monroe County Drain Commission issued drain code and soil erosion violations. This notice ordered Mr. Curry to complete the following: complete a permit application and pay the required $50.00 application fee, submit a site plan showing all work, remove excess sediment buildup from the Wittkop Drain, remove undersized culvert from Wittkop Drain, repair drain banks and re-grade washout area, restore all disturbed ground with seed and mulch and use silt fencing and riprap as needed to restore the area. Mr. Curry has requested an additional pond permit extension to complete his project. Motion by Trustee Juckette and supported by Trustee Williams to direct Attorney James Petrangelo to proceed with court action regarding the pond violations stipulated in the previous agreement with Mr. Dennis Curry located at 1692 Irish Road. Roll call vote as follows: Trustee Juckette yea, Trustee Williams yea, Trustee Larson yea, Treasurer Goetz yea, Trustee Lazette yea, Clerk Lupu yea and Supervisor Uhl yea. Motion carried.
Assessing Department
Several bulletins have been received from the State Tax Commission regarding numerous changes. The assessing department has balanced with the treasurer's department. The total taxable value calculated for the township is $312,753,992.00. The dollars generated for the general operating budget is $291,768.20. The total dollars generated for all millages collected for the township which includes the road and the fire department is $829,048.28.
Building Department
Weekly continuing education classes are occurring. Compliance of permits is being monitored.
Trustee Williams
The planning commission meeting is moved to Wednesday November 14, 2007 due to the Thanksgiving holiday.
Trustee Larson
The library exterior stair railings were replaced. DEQ has been contacted for an update on the Simon Landfill.
Trustee Lazette
A meeting regarding CAFO farms was held October 23, 2007. There are 200 CAFO farms in Michigan with 12 in Lenawee County alone. An estimated $300,000.00 in damages to the roads occurred in 2004 relating to these farms. Animal waste accumulated from these farms is spread through the use of liquid manure spreaders regardless of the temperature of the ground. Frozen ground allows the waste to run off into area water ways and potentially into drinking water. One farm in Lenawee County is located 25 miles from the water source used by Deerfield, Adrian and Blissfield.
Trustee Juckette
The area catch basins still have not been cleaned out. A notice will be sent to the road commission.
Treasurer Goetz
Tax forms are being printed for the December 1, 2007 mailing deadline.
Clerk Lupu
The annual fire pay was processed with a total payroll of $45,485.00 paid to 27 firemen. Fire calls responded to for the time period spanning November 1, 2006 through October 31, 2007 is as follows: 430 for the village and 168 for the township with a grand total of 598.
A meeting will be scheduled with the road commission for January to discuss local issues.
The January 15, 2008 election is still on hold until the state gives final verification.
OLD BUSINESS
A final version of Noise Ordinance #32 was presented to board members. A minor change to Section 3, line item 3 added the word "written" to warning for further clarification. Motion by Trustee Williams and supported by Trustee Larson to adopt Noise Ordinance #32 with the addition to Section 3 item 3 adding "written" wording to the first offense line item. Roll call vote as follows: Treasurer Goetz yea, Trustee Juckette yea, Trustee Lazette yea, Trustee Williams yea, Trustee Larson yea, Clerk Lupu yea and Supervisor Uhl yea. Motion carried. A summary of the ordinance will be published in a newspaper and adoption will be complete 30 days after the publication date.
A 2008 master list of projects will be sent to the road commission. Motion by Clerk Lupu and supported by Trustee Lazette to send the following 2008 master list projects to the road commission consisting of the asphalt capping and heavy maintenance for phase II of Bigelow Road from the S-curves to Plank Road and berm removal and stoning of the following roads: the entire length of Lenawee Road, the entire length of Collins Road, the entire length of Cake Road, Gloff Road from the end of the asphalt section to Ida West Road and Dunbar Road from Wells Road to Nieman Road. Motion carried.
The annual license fee will need to be determined for the mineral extraction ordinance. A $500.00 per year annual fee was discussed. Motion by Trustee Larson and supported by Treasurer Goetz to approve Resolution 2007-6 establishing the annual license fee of $500.00 for the Mineral Extraction Ordinance. Roll call vote as follows: Trustee Williams yea, Trustee Lazette yea, Trustee Larson yea, Treasurer Goetz yea, Trustee Juckette yea, Clerk Lupu and Supervisor Uhl yea. Motion carried.
The presidential primary scheduled for January 15, 2008 will cost the state of Michigan an estimated $10,000,000.00. Motion by Trustee Williams and supported by Trustee Lazette to adopt Resolution 2007-7 Opposing the January 15, 2008 Presidential Primary Election. Roll call vote as follows: Treasurer Goetz yea, Trustee Juckette yea, Trustee Larson yea, Trustee Lazette yea, Trustee Williams yea, Clerk Lupu yea and Supervisor Uhl yea. Motion carried.
OTHER BOARD COMMENTS
Trustee Juckette questioned the status of the joint fire authority information. Trustee Larson stated that the attorney was sent the information and is currently formulating an agreement.
Motion by Trustee Larson and supported by Treasurer Goetz to pay the bills in the amount of $41,233.31. Motion carried.
Motion by Clerk Lupu and supported by Trustee Lazette to adjourn the meeting. Motion carried. Time of adjournment was 8:17 p.m.
